Major changes in EU law at the horizon that will affect IP

Summary

In Dec 2017, the EU regulations 1257/2012 and 1260/2012, both concerning the unitary patent (UP), and the agreement on a unified patent court (UPC) will (most likely) enter into force. This will be a jumping start of a completely new unified European patent system.

In June 2017 the EU-Directive 2016/943 on the protection of trade secrets (undisclosed know-how and business information) entered into force. For the first time, EU-wide legal standards on the protection of such trade secrets and its enforcement will so be created.

In April 2016 the General Data Protection Regulation 2016/680 entered into force. It gives citizens back control over their personal data and to simplify and unify the regulatory environment for business within the EU and that enters into application on 25 May 2018.

These three new laws within the EU will have a considerable impact onto the way how IP issues, trade secrets and personal data (e.g. of inventors) are handled by and within the companies and will force them to review their strategies, policies, guidelines and working procedures connected with IP.

In 2017, the two SIG-IAM meetings will focus on these three late-breaking topics: in June, we will explore the situation in the EU, but we will also address the current practice of Patent Prosecution Highway (PPH). In November, we will focus on the US and other major economic areas outside Europe in order to understand the commonalities and differences and how to turn these findings into practice.
